Privacy Statement

1. Overview

AuroraRP and its subsidiaries (collectively, "Aurora" or AuroraX” or "we" or "our") respect your privacy. This privacy policy (this "Policy") informs you of our privacy practices and the choices you can make about the way your information is collected online and how that information is used.

This Policy applies to all websites, servers and services owned or provided by Aurora (collectively, "Aurora Sites"). Aurora may add new sites, domain names or services from time to time. As explained below, this Policy applies only to websites owned and services maintained by Aurora and not to websites or services to which links may be provided on Aurora Sites.

BY USING THIS SITE, OR ANY PRODUCT OR SERVICE OFFERED ON THIS SITE, YOU CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF INFORMATION AS DESCRIBED IN THIS POLICY.

Collection of Personal Information Aurora collects personal information from users of Aurora Sites in connection with the access and use of the various products and services available to you on Aurora Sites. These products and services may include: (i) registration as a Aurora user and/or subscribing to Aurora Donator; (ii) use of the AuroraX Client; (iii) registration for competitions and events; (iv) registration for receipt of communications like email updates and newsletters; (v) registration for certain online community services and tools like message boards, chat rooms, forums, news groups or other community services; (vi) user surveys and polls; (vii) participation in sweepstakes, contests or promotions by sponsored by Aurora or third parties; and (viii) purchasing products and services.

A. Types of Information Collected. Aurora collects information you provide to us. This may include your name, address, ZIP code, telephone number, email address, user IDs and passwords, age and date of birth, gender, billing and transaction information, product and service preferences and contact preferences. In certain instances, you may also submit similar information about other people (such as when shipping products purchased on Aurora Sites).

B. Automatic Data Collection. In addition to the information you provide us, Aurora may also automatically collect information regarding your use of Aurora Sites. Our automatic data collection may include:

1. Cookies, web beacons or other commonly used website analytics tools. These tools collect certain standard information that your browser sends to our website such as your browser type and language and access times. These tools may also collect information about your Internet Protocol (IP) address, clickstream behavior (i.e., the pages you view, the links you click and other actions you take in connection with Aurora Sites) and products and services you use.

2. Pixel tags, web beacons or other commonly used email analytics tools. These tools may collect information when you open an email or click a link contained in an email or on Aurora Sites.

C. Anti-cheat functionality in the AuroraX Client. Certain information regarding your computer and software it contains is required for effective operation of our anti-cheat services. By using the AuroraX Client, you consent to the collection and analysis of information from your computer that Aurora deems reasonably necessary to identify and prevent the use of cheat software, files used to gain an unfair advantage, and to enforce bans. This information collection is not strictly limited to when you are logged in to the AuroraX Client. Information analyzed or collected by the AuroraX Client may include hardware, network and software identifiers; running programs; system configuration information; files or data suspected of being used to cheat or gain an unfair advantage; or screenshots while you are logged in and playing a game through the AuroraX Client.

D. Commingled Information. Aurora may also collect information from commercially available sources that it deems credible. Such information may include your name, address, email address and demographic data. The information Aurora collects from its commercial sources may be used along with the information Aurora collects when you visit Aurora Sites. For example, Aurora may compare the geographic information acquired from commercial sources with your IP address to derive your general geographic area.

E. Community Tools. From time to time, Aurora may make message boards, chat rooms, forums, news groups and other community tools available to you on Aurora Sites. Please keep in mind that whenever you voluntarily disclose personal information in these public areas, your information becomes public information and can be viewed and used by Aurora and others.

F. Purpose for data collection. Data is collected for business requirements including the provisioning of Aurora services and its functions and contents, answering contact requests and communicating with users, security measures, and audience measurement and marketing.

2. How We Use Your Personal Information

We use the personal information you provide to us (i) in the manner described in this Policy, (ii) to improve and customize this site and the products and services offered to you, and (iii) as directed by you as indicated by your use of the products and services offered on this site. For example, we may use your personal information in connection with the following:

A. Creation of membership accounts;
B. Detection and prevention of cheats
C. Enforce bans;
D. Offers to participate in competitions and event;
E. Delivery of email updates and newsletters;
F. Communications of offers for promotions, sweepstakes and contests;
G. Invitations to participate in user surveys and polls;
H. Execution of purchases of products and services; and
I. Providing software updates and interactive materials.

We may also use your personal information to contact you offline concerning the products and services offered on this site. You are able to opt out of communication at any time by using the “unsubscribe” feature within the communication you receive, or by revoking consent to our services.

3. Sharing of Personal Information

Aurora will not sell, rent or lease the personal information you provide. Aurora will only share your personal information:

A. With entities owned or controlled by Aurora;
B. With your consent;
C. With persons or entities engaged by Aurora to carry out or fulfill Aurora operations;
D. In connection with a merger, acquisition, reorganzization or sale of assets by Aurora;
E. As required by a duly authorized request from a government authority, to comply with any law, regulation, warrant, subpoena or order from a court or governmental authority, and to help prevent or investigate suspected fraud, harassment or violation of any law, rule, regulation, Aurora policy or Aurora terms and conditions; and
F. As otherwise stated in this Policy.

4. Use and Disclosure of Anonymous Information

We may collect certain non-personally identifiable information (i.e., generic information that does not identify you personally) when you visit any Aurora Site. We may use non-personally identifiable information that we collect to improve the design and content of Aurora Sites and to enable us to personalize the products and services offered on Aurora Sites. We may also aggregate non-personally identifiable information collected in a manner which does not identify any individual. We reserve the right to use this information in any manner we deem appropriate.

5. Children Under 13

Aurora Sites are not directed to children under the age of 13. Aurora Sites prohibit registration by, and Aurora will not knowingly collect personally identifiable information from, anyone under the age of 13. If you believe Aurora has collected personal information about your child, you may contact us at the address set forth below to request removal of such information.

6. Links to Third Party Sites

Aurora Sites may include links to third party websites or services. Aurora does not control such third party sites and their privacy practices are not covered by this policy. The presence of a link on Aurora Sites does not constitute an endorsement or representation regarding any third party website or service.

7. Information Storage and Security

The protection of your personal information is important to Aurora. To prevent unauthorized access or disclosure of this information, Aurora utilizes appropriate physical, technical and administrative procedures to safeguard the information we collect. However, no system can ever be fully protected against every possible hazard and we cannot guarantee that communications between you and us or the information stored on Aurora Sites or our servers (or those of our agents and service providers) will be completely free from unauthorized access and disclosure and your use of any Aurora Site demonstrates your assumption of this risk.

8. Your Choices

Aurora provides you with the opportunity to choose and alter your preferences regarding the communications you receive from us. You will be provided with the opportunity to indicate whether you want to receive general communications about products, services, special offers or invitations to participate in various programs. You may opt out of receiving these general communications by using one of the following methods: (i) select the email "opt out" or "unsubscribe" link, or follow the opt-out instructions included in each communication, or (ii) write to Aurora at the address below. Be sure to provide your name, email and postal address, and specific relevant information about your privacy preferences. Subscription communications may include email newsletters and updates expressly requested by you. After you request such communications, you may opt out of receiving them by using one of the following methods: (i) select the email "opt out" or "unsubscribe" link, or follow the opt-out instructions included in each subscription communication, or (ii) return to the Web page(s) where you originally requested such services and follow the opt-out instructions.

You may change or edit information you have provided as part of your user profile by logging in to your Aurora account and changing the information. You may export and delete your user profile by logging into your Aurora account accessing your privacy settings. You may revoke consent at any time by logging into your Aurora account and accessing your privacy settings.

9. International Users

If you are visiting this site from a location outside Singapore, your connection will be through servers located in the Singapore and all information you provide will be processed and maintained in our web servers and internal systems located within Singapore. By using this site, you authorize the export of personal information to Singapore and its storage and use as specified above.

10. Payment Transactions

For a contract, in which you have to pay a fee, provided that the purchase was made via the website, your credit card information will be collected by the payment processor (credit card number, country, holder of the credit card) in accordance with Art. 6 (1) (a) and (f) GDPR credit card, credit card verification code (CVV code) and expiration date of your credit card), your name, bank account number and bank code if you choose the direct debit or if you choose another payment method or if you choose SEPA direct debit, your IBAN (international bank account number) and your BIC (International bank code of the institution of the debtor), and your home address. Please note that your credit card details or PayPal payments are collected and processed by your payment processor in relation to your payments for the service.

11. Social Media

Aurora maintains online presence within social networks and platforms in order to communicate with customers and users active there, and to inform them about Aurora services. When calling the respective networks and platforms, the terms and conditions and the data processing guidelines apply to their respective operators.

Unless otherwise stated in our Privacy Policy, users' data will be processed as long as they communicate with Aurora within social networks and platforms, e.g. write posts on Aurora’s online presence or send messages.

12. Integration of Services and Contents of Third Parties

Based on Aurora’s legitimate interests (such as interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 (1) lit. GDPR), Aurora make use of content or services offered by third-party providers in order to provide their content and services, such as including videos (hereinafter collectively referred to as "Content").

This always presupposes that the third party providers of this content perceive the IP address of the users, since they could not send the content to their browser without the IP address. The IP address is therefore required for the presentation of this content. Aurora endeavors to use only content whose respective providers use the IP address solely for the delivery of the content. Third parties may also use so-called pixel tags (invisible graphics, also referred to as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may include, but is not limited to, technical information about the browser and operating system, referring web sites, visit time, and other information regarding the use of Aurora Sites.

Aurora also use social plugins ("plugins") of the social network facebook.com, which is provided by Facebook Ireland, on the basis of Aurora’s legitimate interests (analysis, optimization and economical operation of Aurora’s online offer as defined in Art. 6 (1) lit. GDPR) Ltd., 4 Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland ("Facebook"). The plugins can represent interaction elements or content (such as videos, graphics or text contributions) and can be recognized by one of the Facebook logos (white "f" on blue tile, the terms "Like", "Like" or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin". The list and appearance of Facebook Social Plugins can be viewed here: https://developers.facebook.com/docs/plugins/.

Facebook is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European privacy legislation (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

When a user invokes the feature that contains such a plugin, their device establishes a direct connection to the Facebook servers. The content of the plugin is transmitted by Facebook directly to the device of the user and incorporated by him into the online offer. In the process, user profiles can be created from the processed data. Aurora has no control over the amount of data Facebook collects using this plugin.

By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offer. If the user is logged in to Facebook, Facebook can assign the visit to his Facebook account. If users interact with the plugins, for example, press the Like button or leave a comment, the information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, there is still the possibility that Facebook will find out and save their IP address.

If a user is a Facebook member and does not want Facebook to collect data about him via this online offer and link it to his member data stored on Facebook, he must log out of Facebook and delete their cookies before using Aurora Sites. Other settings and inconsistencies regarding the use of data for advertising purposes are possible within the Facebook profile settings: https://www.facebook.com/settings?tab=ads or via the USA site http://www.aboutads.info / choices / or the EU page http://www.youronlinechoices.com/. The settings are platform independent and they are adopted for all devices, such as desktop computers or mobile devices.

C. Twitter

Features of the Twitter service are included on Aurora Sites (Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA). By clicking on the Twitter button and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and shared with other users. This data is also transmitted to Twitter. Aurora points out that as the provider of the Aurora Sites, Aurora is not aware of the content of the transmitted data and their use by Twitter.

These Terms of Use ("Terms") govern your use of, purchase of, or subscription to AuroraRP ("Aurora") websites, software, products or services (collectively, the "Services").

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING, PURCHASING OR SUBSCRIBING TO THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS WITHOUT LIMITATION OR QUALIFICATION. IF YOU DO NOT ACCEPT THESE TERMS OF USE, DO NOT USE ANY PART OF THE SERVICES.

By using the Services you consent to the collection, use and disclosure of your information as described in Aurora's Privacy Policy. Additional terms may apply to contests, promotions or other Aurora events or activities that you may choose to participate in.

1. License to Use the Services

Conditioned upon your acceptance of these Terms, Aurora authorizes you to use the Services for your personal, non-commercial use. Any use of the Services in any way not expressly permitted by these Terms is prohibited, and may be actionable under the law. Aurora shall have the right at any time and from time to time to change or discontinue any aspect or feature of the Services, including, but not limited to, content, hours of availability and equipment needed for access or use.

2. Your Conduct and Responsibilities

1. propagation of computer worms, viruses and other such malicious code,

2. using (directly or indirectly) the Services to make unauthorized entry to any other machine accessible through the Services, and

3. use of the Services to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users of the Services to become users of other on-line services.

Without limiting any other rights or remedies of Aurora, violations of the foregoing may result in removal of any prohibited communications and/or termination of your access to the Services.

D. You shall not upload, post, submit or otherwise make available on the Services any material protected by copyright, trademark or other proprietary right without the express permission of the owner. You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. E. By appearing and participating in any Aurora competition, you grant Aurora and its assignees and licensees right to review and make public any and all game play, film, photograph and record your name, nickname, pseudonym, persona, picture, biographical material, voice and/or likeness and to use and distribute the same in any manner or media whatsoever, by any and all means, media, devices, processes and technology now or hereafter known or devised anywhere in the universe at any time in perpetuity, for any lawful purpose whatsoever, including advertising, publicity or trade.

3. Intellectual Property and Proprietary Rights

The Services contain copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Services are copyrighted as a collective work under the Philippine copyright laws. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works or in any way exploit any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial or non-commercial exploitation of material on the Services will be permitted without the express permission of Aurora and the copyright owner. You acknowledge and agree that you do not acquire any ownership rights by accessing or otherwise using copyrighted material.

Aurora, AuroraX, Aurora Donator, and other Aurora graphics, logos, designs, page headers, button icons, scripts and service names (jointly referred to as "Aurora Marks") are the exclusive property of Aurora All rights reserved. Aurora Marks and trade dress may not be used, including as part of trademarks or domain names, in connections with any product of service that is likely to cause confusion and may not be copied, imitated, or used, in whole or part, without the prior written permission of Aurora.

4. Changes to these Terms

Aurora may from time to time to change or modify these Terms of Use or impose new conditions, including, but not limited to, adding fees and charges for use. All such changes, modifications, additions or deletions shall be effective immediately upon posting notice on the Services. You acknowledge and agree that any use of the Services by you after such notice constitutes your acceptance to the modified Terms.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY.

Aurora ITSELF MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD OR SUBSCRIBED TO THROUGH THE SERVICES.

PRODUCTS AND SERVICES PURCHASED OR SUBSCRIBED TO ARE PROVIDED OR SOLD "AS-IS" AND Aurora DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Aurora CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF PRODUCTS OR SERVICES. Aurora DOES NOT REPRESENT OR WARRANT THAT PRODUCTS, SERVICES OR ANY PART THEREOF, ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT PRODUCTS OR SERVICES THAT ARE DOWNLOADED FROM THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Aurora ASSUMES NO LIABILITY IN CONNECTION WITH ANY USE OF THE SERVICES. USE OF THE SERVICES IS AT YOUR SOLE RISK. EXCEPT IN JURISDICTIONS WHERE SUCH PROVISIONS ARE RESTRICTED, IN NO EVENT WILL Aurora OR ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR PURCHASE, SUBSCRIPTION OR USE OF ANY PRODUCTS OR SERVICES, EVEN IF Aurora IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, Aurora'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO Aurora FOR THE PRODUCT OR SERVICE. YOU ACKNOWLEDGE THAT IF NO AMOUNT IS PAID TO Aurora FOR THE PRODUCT OR SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM Aurora, REGARDLESS OF THE CAUSE OF ACTION.

7. Monitoring

Aurora shall have the right, but not the obligation, to monitor the content of the Services, including chat rooms and forums, to determine compliance with these Terms of Use and any operating rules established by Aurora and to satisfy any law, regulation or authorized government request. Without limiting the foregoing, Aurora shall have the right to remove any material that Aurora, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

8. Indemnification

You agree to defend, indemnify and hold harmless Aurora, Aurora affiliated companies and their respective directors, officers, employees, agents, assignees and licensees from and against all claims and expenses, including attorneys' fees, resulting from (i) any breach of these Terms of Use or your negligent and wrongful conduct; (ii) your use and access of the Services, including the posting of any content on the Services by you; and (iii) violation by you of any applicable law, rule or regulation.

9. Termination

You may unsubscribe through cancelling payment through your payment provider. Without limiting the foregoing, Aurora shall have the right to immediately terminate any of your passwords or accounts in the event of any conduct by you which Aurora, in its sole discretion, considers to be unacceptable, or in the event of any breach by you of these Terms of Use. The provisions of Sections 3, 4, 5, 6, 8, 10, 11, 12 and 13 shall survive termination of these Terms of Use.

11. Third Party Content

Aurora is a distributor (and not a publisher) of content supplied by third parties and users of the Services. Accordingly, Aurora has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or any user of the Services are those of the respective author(s) or distributor(s) and not of Aurora. Neither Aurora nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. Refer to Sections 3 and 4 above for the complete provisions governing limitation of liabilities and disclaimers of warranty.

In many instances, the content available through the Services represents the opinions and judgments of the respective information provider or users not under contract with Aurora. Aurora neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on the Services. Under no circumstances will Aurora be liable for any loss or damage caused by your reliance on information obtained through the Services. It is your responsibility to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through the Services.

12. Terms of Sale

The following terms apply to your purchases or subscriptions related to the Services.

A. Purchase Qualifications; Account Security

To purchase a product or subscription related to the Services, you must be a registered Aurora User and comply with these Terms of Use. You acknowledge that you are responsible for maintaining the security of, and restricting access to, your account and password, and you agree to accept responsibility for all purchases and other activities that occur under your account. Aurora sells its products only to those users who can legally make purchases using one of the accepted payment methods. If you are under 18, you may make purchases on Aurora only with the involvement of a parent or guardian. Aurora reserves the right to refuse or cancel orders or terminate accounts, at any time in its sole discretion.

B. Payment Method and Terms

We accept payments made through PayPal, GCash, and Paymaya in connection with the purchase of any merchandise or subscription through the Services. By submitting an order through Aurora, you authorize Aurora, or its designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in Philippine Peso.

C. Product and Service Descriptions and Availability, Errors

Aurora and its suppliers continually upgrade and revise its products and services to provide you with new products and services. Aurora may revise, discontinue or modify products or services at any time without prior notice to customers, and products or services may become unavailable without notice. Aurora shall have no liability of any kind if a product or service that has been ordered is unavailable. If necessary, Aurora reserves the right to substitute items of equal or greater value when an item or service is unavailable or Aurora may cancel the order.

We attempt to be as accurate as possible and eliminate errors on the Services, however we do not warrant that any product, service or description, photograph, pricing or other information is accurate, complete, reliable, current, or error-free. In the event of an error, whether on the Services, in an order confirmation, in processing an order, delivering a product or service or otherwise, we reserve the right to correct such error and revise your order accordingly if necessary (including charging the correct price) or to cancel the order and refund any amount charged. In addition, we may, in lieu of a refund as provided in this paragraph, opt to provide you with a merchandise or service credit, with a value at least equal to the amount charged to your account. Aurora reserves the right to determine and modify from time to time the exact nature of any such merchandise or service credit, including conversion into one or more different types of merchandise or service credits. D. Refunds and Returns

All merchandise must be inspected by customer upon delivery. If any box looks dented or damaged in any way, the driver must make a notation and should mark any damages. Boxes opened later and then damage noticed without driver making notation, is considered concealed damage. Some shipping companies do not always cover full refunds on concealed damage items. Aurora is not responsible for damaged incurred during shipping. There are no returns or cancellations for any intangible property or services purchased from Aurora, including without limitation paid subscriptions and Lessons.

Returns are permitted only in the event of an error committed by Aurora. You must email or call first for a return authorization number, and no merchandise can be returned without a written authorization number. Items must be unopened, in new condition, and returned in original shipping containers. All sales are final, noncancelable and nonrefundable except as expressly set forth in this Agreement or as otherwise determined by Aurora in its sole discretion.

13. Copyright Complaints

Aurora owns, protects and enforces copyrights in its own creative material and respects the copyright properties of others. You are prohibited from uploading, posting or otherwise transmitting on the Services any materials that violate another party's intellectual property rights. When we receive proper notification under our DMCA Policy, we promptly remove or disable access to the alleged infringing materials and terminate the accounts of repeat offenders. Aurora's DMCA Policy is hereby incorporated into these Terms of Use.
