TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION

Definitions

  • "License" shall mean the terms and conditions for use, reproduction, and distribution as defined by Sections 1 through 9 of this document.
  • "Licensor" shall mean Emanuele Balsamo, the creator of CyberPath.
  • "You" (or "Your") shall mean an individual or Legal Entity exercising permissions granted by this License.
  • "Work" shall mean the software, documentation, or other materials made available by Licensor, known as "CyberPath."
  • "Derivative Works" shall mean any work based upon or derived from the Work, where the modifications constitute, as a whole, an original work of authorship.

1. Grant of Copyright License

Subject to the terms and conditions set forth herein, Licensor hereby grants You a non-exclusive, royalty-free, revocable license to use the Work solely for private use. Commercial use of the Work is expressly prohibited, except as permitted by Emanuele Balsamo in writing. All rights not expressly granted are reserved by the Licensor.

2. Grant of Patent License

No patent rights are granted under this License, except those that are expressly permitted by Emanuele Balsamo. Any patent rights with respect to the Work are reserved exclusively by the Licensor.

3. Redistribution and Distribution Restrictions

  • Prohibition on Redistribution: You are expressly prohibited from reproducing, distributing, or sublicensing the Work or any Derivative Works, in any form or medium, unless prior written authorization is obtained from the Licensor.
  • Prohibition on Rebranding: Distribution of the Work or any Derivative Works under any name or branding other than "CyberPath" is strictly prohibited.
  • Permission for Distribution: In the event that written permission is granted by the Licensor, You must provide proper attribution to the Work and to Emanuele Balsamo, and must clearly state any modifications or alterations made to the original Work.

4. Trademarks

This License does not grant permission to use any trade names, trademarks, service marks, or product names of Emanuele Balsamo, including but not limited to "CyberPath." Any such usage is expressly reserved to the Licensor.

5. Attribution and Modification Notice

In the event that You create any Derivative Works or make any modifications to the Work, You shall:

  • Retain the original copyright notice of CyberPath in all copies.
  • Attribute the original Work to Emanuele Balsamo.
  • Include prominent notices that clearly indicate the nature and extent of any changes made to the Work.

6. Disclaimer of Warranty

The Work is provided on an "AS IS" basis, without any warranty or condition, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk as to the quality and performance of the Work is with You. Should the Work prove defective, You assume the cost of all necessary servicing, repair, or correction.

7. Limitation of Liability

In no event shall Emanuele Balsamo, the Licensor, be liable for any damages, including any direct, indirect, incidental, special, or consequential damages arising from or in connection with the use or inability to use the Work, even if advised of the possibility of such damages. This includes, but is not limited to, loss of goodwill, business interruption, or any other commercial or personal damages.

8. Termination

This License shall terminate automatically if You fail to comply with any term or condition of this License. Upon termination, You must immediately cease all use of the Work and destroy any copies or Derivative Works in Your possession.
