Q: In addition it should maybe check for Enabled & Visibility by default?
A: Just allow the attributes "visibility" and "status" for promo rules in *Catalog > Attributes > Manage Attributes".

We have seen that selecting category products when both simple, configurable and bundled exist that the "selection list" you see is extremely long. For example: when 4 configurable products exist with 10 simple underlying products, then I would expect to see only the 4 configurable products.

So the point of this issue is that when setting up a new dynamic category you would only expect to see the products that are Saleable() (Enabled & Visibility catalog or catalog/search)
