Steps to reproduce the problem

  1. Set up a new instance

Expected behaviour

Sensible defaults useful for most admins

Actual behaviour

Heavily USA-centric ToS text is generated

Detailed description

https://github.com/mastodon/mastodon/pull/33055/files introduced a ToS generator which is a nice nudge to produce some ToS but unfortunately includes some extremely problematic language and assorted USA-centric provisions such as

  • DMCA
  • New York jurisdiction
  • Mandatory arbitration
  • Liability provisions
  • Implicit references to COPPA
  • Implicit references to USA law in assuming that lines 50-51 imply lines 54-69

The "Intellectual property" section also requires rather broad licensing which may or may not be compatible with Creative Commons licenses.

The wizard should first ask whether the chosen jurisdiction is in the USA, and if not avoid suggesting most of the text in the current template.
