PLEASE READ CAREFULLY:  THIS SOFTWARE LICENSE AGREEMENT (“AGREEMENT”) IS A 
LEGAL AND BINDING AGREEMENT BETWEEN YOU AND/OR YOUR ORGANIZATION (“LICENSEE”), 
AND DATASTAX, INC. (“DATASTAX”) WITH RESPECT TO THIS AMI IMAGE MADE AVAILABLE 
BY DATASTAX (THE “AMI IMAGE”). 

BY USE OF THIS AMI, LICENSEE AGREES TO ALL TERMS AND CONDITIONS OF THIS 
AGREEMENT.

The AMI Image is comprised principally of third party elements (collectively 
and each, the “Third Party Software”). Licensee acknowledges that DataStax has 
no proprietary interest in the Third Party Software, and as such, cannot grant 
you a license to use such Third Party Software. A listing of such Third Party 
Software is available upon written request from DataStax.  Your rights in the 
Third Party Software are governed by and subject to the terms and conditions 
set forth in the applicable third party licenses set forth with such listing. 
By installing or using such Third Party Software, you acknowledge and agree to 
fully comply with such terms and conditions. 

IN ADDITION TO ANY DISCLAIMERS SET FORTH IN SUCH THIRD PARTY TERMS AND 
CONDITIONS, DATASTAX MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO 
THE AMI IMAGE, AND DATASTAX HEREBY EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED 
WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF 
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INTERFERENCE, ACCURACY 
OF DATA, AND NON-INFRINGEMENT.

UNLESS PROVIDED PURSUANT TO A SEPARATE WRITTEN AGREEMENT, DATASTAX IS NOT 
OBLIGATED TO PROVIDE SUPPORT SERVICES FOR THE AMI IMAGE OR ANY THIRD PARTY 
SOFTWARE.
