This EULA governs the use of Campus ("the App"), an all-platform educational tool designed to facilitate learning, teaching, evaluation, and the creation and management of academic materials. By using the App, users agree to be bound by the terms of this EULA.
Campus grants users a non-exclusive, non-transferable, revocable license to use the App for educational purposes, including accessing, downloading, and using academic materials, subject to the terms of this EULA.
Users must not redistribute content from the App, including content created by Campus or user-generated content, outside of the App environment. The App is not to be used for any malicious educational purposes or activities that could harm others or the reputation of Campus. Users are prohibited from attempting to hack the App, using it for illegal activities, or distributing academic materials outside the App.
Users may create content within the App. Campus retains all rights to user-generated content and may use, distribute, or modify this content without restriction.
Access to the App requires a monthly subscription. Payments are processed through app stores or a designated web payment provider. Users agree to the payment terms set by their respective payment providers and are responsible for all charges incurred.
Campus (the company) owns all rights, title, and interest in the App, including all software, content, and trademarks.
Campus collects only usernames, passwords, and email addresses for account registration. Academic materials created or submitted by users may be distributed within the App. Users acknowledge that Campus does not share user data with third parties.
Campus does not warrant that the App will be error-free or uninterrupted. The App is provided "as is" without warranties of any kind. Campus is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the App.
Campus reserves the right to terminate a user's access to the App for violations of this EULA, including, but not limited to, hacking attempts, malicious use, or unauthorized distribution of content. Upon termination, Campus does not currently delete user data but may implement this functionality in the future.
Any disputes, claims, questions, or disagreements arising out of or relating to this End User License Agreement (EULA) or the breach thereof, shall initially be resolved through good faith negotiations between the parties. If such disputes cannot be settled amicably within a period of 60 days, then the parties agree to submit the dispute to binding arbitration.
The arbitration shall be conducted in accordance with the Commercial Arbitration Rules of the Arbitration Foundation of Southern Africa (AFSA) and shall take place in [Your City, South Africa]. The arbitration shall be conducted in the English language. The decision of the arbitrator shall be final and binding on both parties, and the arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the foregoing, the parties agree that any matters not subject to arbitration, as well as any legal actions to enforce the arbitration award, shall be brought in the courts of Johannesburg, South Africa. The parties hereby consent to the exclusive jurisdiction and venue of such courts for these purposes.
Campus reserves the right to modify or update the App and this EULA at any time. Users will be notified of significant changes via email or push notifications.
